16.09.2026 Court No.35. M/L.245. Rakib (Allowed) CRM (NDPS) 1692 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kumarganj Police Station case no. 442 of 2025 dated 19.12.2025 under Sections 21(c)/22(c)/23(c)/25/27(A)/28/29 of the NDPS Act. And In the matter of : Kawchhar Mandal ……Petitioner. Mr. Ayan Bhattracharjee, Sr. Adv, Mr. Kaushik Choudhury Mr. Dwaipayan Panda ......for the Petitioner. Mr. Krishnendu Bhattacharya, Ld. APP Ms. Tanushree Kar ……for the State. Learned senior advocate appearing for the petitioner submits that petitioner is better placed than the other accused person who has been granted bail in CRM (NDPS) 1587 of 2026. Learned advocate appearing for the State opposes the prayer for bail but is unable to refute the contention that the petitioner’s name transpires during investigation and there has been no recovery from the present petitioner. Having considered the same, I am of the opinion that the petitioner be released on bail on same terms and conditions as was imposed upon Alok Shil in CRM (NDPS) 1587 of 2026. Accordingly, the prayer for bail of the petitioner namely, Kawchhar Mandal is allowed. Thus, CRM (NDPS) 1692 of 2026 is allowed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
