This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 has been filed by the petitioner namely, Paban Doley, seeking bail in connection with Sessions (Special)/Special (POCSO) Case No.194/ 2025 under Sections 64(2)(f)/64(2)(m)/65(1)/351(2) of BNS read with Section 6 of the POCSO Act, arising out of Narayanpur P.S. Case No.57/2025, which is pending in the Court of learned Special Judge (POCSO), Lakhimpur, North Lakhimpur. 3. As per allegation, the petitioner was in a love relationship with the alleged victim, who was aged about 16-17 years at the time of occurrence and established physical relationship with her. 4. The I.O. has completed the investigation and submitted charge-sheet, after which, trial commenced. In course of trial, the informant as well as the victim have been examined and none of them have implicated the present petitioner and they were declared hostile. In the meantime, the petitioner has been behind the bars for 175 days. 5. Having regard to the above, the prayer for bail is allowed. 6. Accordingly, it is provided that the petitioner, named above, shall be released on bail of Rs.40,000/- (Rupees Forty Thousand) with 1(one) surety of the like amount to the satisfaction of the learned Special Judge Page No.# 3/3 (POCSO), Lakhimpur, North Lakhimpur in connection with the aforementioned case. 7. The direction for bail is further subject to the conditions that the accused petitioner – (1) shall regularly participate in the trial ; and (2) shall not try to influence the witnesses of the case. 8.
