JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.4 in C.C.No.48010/2026 arising out of Crime No.199/2021 registered by Sanjay Nagar Police Station, Bengaluru City, for the offences punishable under Sections 399 and 402 of IPC, 1860, is before this Court in this petition filed under Section 483 of BNSS 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that the petitioner, who was initially arrested in the - 3 - HC-KAR CNR: KAHC010617092026 NC: 2026:KHC:51128 CRL.P No. 13845 of 2026 present case was subsequently enlarged on bail. It appears that after the charge sheet was filed in the present case, he had not appeared before the Court. Therefore, a split up case was registered against him and in the said case, his presence was secured on 31.07.2026 and remanded to judicial custody. Thereafter, he had filed a regular bail application before the jurisdictional Sessions Court in Crl.Misc.No.7842/2026, which was rejected on 28.08.2026. Therefore, he is before this Court. 4. On the merits of the case, the petitioner, who was arrested in the present case, was earlier granted regular bail at the crime stage. It appears that after filing of the charge sheet, he has not appeared before the Court and therefore, a split up case was registered against him. In the said case, he is now arrested and remanded to judicial custody on 31.07.2026. 5. The submission made by the learned counsel for the petitioner that the petitioner has no other criminal - 4 - HC-KAR CNR: KAHC010617092026 NC: 2026:KHC:51128 CRL.P No. 13845 of 2026 antecedents is not seriously disputed by the learned High Court Government Pleader. 6. Learned counsel for the petitioner has undertaken before this Court that the petitioner shall appear before the Court regularly and cooperate for the early disposal of the case. 7. Considering the aforesaid aspects, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following: O R D E R i) The Criminal Petition is allowed. ii) The petitioner is directed to be enlarged on bail in C.C.No.48010/2026 arising out of Crime No.199/2021 registered by Sanjay Nagar Police Station, Bengaluru City for the offence punishable under Sections 399 and 402 of IPC, 1860, subject to the following conditions: - 5 - HC-KAR CNR: KAHC010617092026 NC: 2026:KHC:51128 CRL.P No. 13845 of 2026 a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
