1. Supplementary affidavit filed in Court today is taken on record.
2. The instant writ petition had been filed praying for a direction upon the respondent authorities to permit the petitioner to appear in the interview for the post of Group-D staff reserved for the scheduled caste category.
3. The petitioner also challenged the vires of the West Bengal Schools (Recruitment of Non-teaching Staff) Rules, 2005.
4. It appears that during the pendency of the writ petition, the petitioner was permitted to appear in the interview and he was selected in the subject post. His service was also provisionally approved by the Additional District Inspector of Schools, Purulia way back in 2007 subject to the condition that the service of the petitioner will abide

by the result of the instant writ petition and the result of WP 13756 (W) of 2007.
5. Vide order dated 28th December, 2023, WPA 13756 of 2007 (Raju Mandal Vs. The State of West Bengal & Ors.) stood disposed of by the Court.
6. As the preliminary relief sought for by the petitioner has been allowed, the petitioner does not intend to press the challenge to the West Bengal Schools (Recruitment of Non-teaching Staff) Rules,
2005.
7. In view of the above, no further issue remains to be decided in the instant writ petition.
8. The writ petition stands disposed of.
9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
