The family pension file of the petitioner cannot be made ready on account of certain discrepancies which have been pointed out to the petitioner and annexed at Page-101 of the writ petition. 2. Learned advocate for the petitioner submits, upon instruction that, all the objections have been cleared by the petitioner, but despite the same, steps are not being taken by the District Inspector of Schools, Secondary Education, Murshidabad to make the family pension file of the petitioner ready. 3. As the petitioner would be legally entitled to receive the family pension on the death of her husband, accordingly, the District Inspector of Schools, Secondary Education, Murshidabad is directed to grant an opportunity of hearing to the petitioner and the representatives of the school to clear the objections that have been raised. Steps shall be taken in the matter at the earliest but positively Page 2 within a period of three weeks from the date of communication of this order. 4. After clearing all the objections, the District Inspector of Schools, Secondary Education, Murshidabad shall take steps to forward the pension file of the petitioner to the competent authority for preparation of the Pension Payment Order. 5. District Inspector of Schools, Secondary Education, Murshidabad shall ensure that the family pension of the petitioner is disbursed latest within a period of four months from the date of communication of this order. 6. The writ petition stands disposed of. 7. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 8. Certified server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
