CMP(M) No. 139 of 2026 Inter alia, keeping in view the averments made in the application, duly supported by the affidavit of the official, the delay of 103 days in filing the appeal is condoned. The application stands disposed of. It is contended that the enhancement has been done from Rs. 17,750/- per biswa to Rs. 2,94,048/- on the basis of the sale deeds of land which was acquired for the purposes of construction of the Solan–Rajgarh Bypass Road. Counsel for the State further states that it is not disputed that the land falls under the third category in the circle rate, as referred to at the lesser rate as mentioned in paragraph 22. He further submitted that the enhancement, based on three sale deeds, pertains only to a very small portion of the land while referring to paragraph 23. It is submitted that in the sale deeds there is a small portion of land for which no cut was imposed while taking an average. Accordingly, the State shall deposit a sum of Rs. 2,00,000/- per biswa within a period of two months. RFA No. _____ of 2025 Be registered. RFA No. _____ of 2025 Be registered.
