Present Mr. S. Lokhendro, learned counsel for the petitioner and Mr. H. Debendra, learned Dy. A.G. assisted by Ms. I. Sharmila,
learned counsel for the State respondent. [2]
The petitioner who is Joint Director (NFE), Department of SCERT, Government of Manipur approached this Court with a prayer for encadrement of post held by him, i.e., Joint Director as MCS (JAG/Grade-I) under MCS Rules, 1965 as done in the case of Joint Director of the same Department of SCERT and with a prayer for absorption as MCS (JAG/Grade-I). [3]
Mr. H. Debendra, learned Dy. A.G., has raised the question of maintainability of the present writ petition and if the prayer of the writ petition is allowed, it will amount to amendment of MCS Rules, 1965 and the matter lies before the Division Bench. Otherwise also, without amending the relevant MCS Rules, the substantive prayer of the petitioner for absorption in the MCS Grade-I post will not be possible. [4]
At this moment, Mr. S. Lokhendro, learned counsel for the petitioner, on instruction, submits that the petitioner may be permitted to
withdraw the writ petition with liberty to approach the State Authority with a fresh and detailed representation in this regard. [5]
Mr. H. Debendra, learned Dy. A.G., submits that this Court may pass appropriate order to the oral alternate submission of the
learned counsel for the petitioner. [6]
In the circumstances, the writ petition is dismissed as withdrawn with liberty to the petitioner to approach the State Authority for submitting a fresh and detailed affidavit for encadrement of Joint Director (NFE), Department of SCERT, Government of Manipur as cadre of MCS (JAG/Grade-I). [7]
With this observation, writ petition is disposed of. [8]
It is made clear that this Court does not express any opinion on the merit of the case and if the fresh representation is filed, the State Authority may consider as per applicable rules.
