In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Lake Town Police Station Case No. 84 of 2025 dated 24.03.2025 and charge- sheet no. 163 of 2025 dated 30.04.2025 and Supplementary Charge-sheet no. 13 of 2025 under Section 4 of POCSO Act, 2012. Affidavit-of-service filed in Court today be taken on record. 2. Learned Advocate for the petitioner submits that the petitioner is in custody for about one year six months. Prosecution has relied upon twenty eight witnesses and till date only two witnesses have been examined. Learned Advocate submits that on any stringent condition petitioner may be released on bail as there is no scope of the trial being concluded. 3. Learned advocate for the State opposes the prayer for bail and produced the Case Diary. 2 4. I have taken into account the statement of the victim under Section 164 of the Cr.P.C as well as the medico legal examination report. Deposition of the victim has also been placed before this Court and on overall assessment of the set of facts, I am of the view that further custodial detention of the petitioner is unwarranted. As such prayer for bail is allowed. 1. Accordingly, Petitioner, namely, Aman Sha @ Aman Sah @ Aman Shah shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Special Judge (POCSO Act), Barasat, North 24 Parganas. 2. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Special Court. However, the petitioner shall not enter into the jurisdiction of Lake Town Police Station and would meet with the Officer-in- Charge of the concerned Police Station where he would reside once in a month till the evidence of the vulnerable witnesses is concluded. 3. Accordingly, CRM (M) 2137 of 2026 is allowed. 4. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
