2. The petitioner is apprehending his arrest in connection with Complaint Case No.1952 of 2023 for the alleged offences registered under Section 498A of Indian Penal Code and Section 3/4 of Dowry Prohibition Act, pending in the Court of learned Chief Judicial Magistrate, Garhwa.

Learned counsel appearing for the petitioner submits that false allegation is made against the petitioner. She further submits that the petitioner happened to be husband of the complainant and

entire family members have been made accused alleging of torture and demand of dowry.

Learned counsel appearing for the State submits that the matter is arising out of complaint case.

Considering that the matter is arising out of complaint case and the entire family members have been made accused and the case has been registered under Section 498A of Indian Penal Code and Section 3/4 of Dowry Prohibition Act and the petitioner happened to be husband of the complainant and in that view of the matter, the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
