JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Crime No.93/2026 registered by Chennarayapatana Police Station, Bengaluru District, for the offences punishable under Sections 109(1), 351(2), 352 and 54 read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.93/2026 was registered by Chennarayapatana Police Station, Bengaluru District for - 3 - HC-KAR CNR: KAHC010568202026 NC: 2026:KHC:51132 CRL.P No. 12643 of 2026 the aforesaid offences against the petitioner herein, based on the first information dated 15.06.2026 received from Jagadish, brother of the injured Jayachandra. In the said case, the petitioner was arrested on 21.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.15156/2026 was rejected on 27.07.2026. Therefore, he is before this Court. 4. A reading of the first information as well as the charge sheet filed in the present case would reveal that the petitioner and the victim are total strangers. On the alleged date of incident, the petitioner allegedly drove his vehicle in which he was travelling along with accused Nos.2 and 3 in a rash and negligent manner, and therefore, this was questioned by the injured victim Jayachandra. Thereafter, there was a quarrel between the petitioner and Jayachandra. The petitioner allegedly picked up a stone from the roadside and assaulted Jayachandra with the same, causing grievous injuries. The injured - 4 - HC-KAR CNR: KAHC010568202026 NC: 2026:KHC:51132 CRL.P No. 12643 of 2026 Jayachandra, who was admitted to the hospital, has been discharged and his condition is said to be stable. Investigation of the case is already completed. It is not in dispute that the petitioner has no other criminal antecedents. Under the circumstances, the following: O R D E R i) The Criminal Petition is allowed. ii) The petitioner is directed to be enlarged on bail in Crime No.93/2026 registered by Chennarayapatana Police Station, Bengaluru District, for the offences punishable under Sections 109(1), 351(2), 352 and 54 read with Section 3(5) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR CNR: KAHC010568202026 NC: 2026:KHC:51132 CRL.P No. 12643 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
