1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel for the Petitioner and learned Additional Standing Counsel for the State. Perused the records.
3. This is an application under Section 439, Cr.P.C filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 20(b)(ii)C, 25 & 29 of the N.D.P.S Act in G.R Case No.18 of 2022 of the Court of learned Special Judge, Gajapati, Paralakhemundi arising out of Mohana P.S Case No.21 of 2022.
4. It is stated by learned counsel for the Petitioner that in the meantime some of the co-accused persons, who had faced the trial, have been acquitted. He further submitted that the Petitioner, who happens to be the owner of the vehicle, is ready and willing to surrender before the court below and cooperate with the trial.

5. Considering the facts of the case, this Court is not inclined to grant anticipatory bail to the Petitioner. However, it is observed that the Petitioner, if so advised, may surrender before the learned court in seisin over the matter, in the aforesaid case within two weeks from today. In the event the Petitioner surrenders and moves for bail within the aforesaid period, learned court in seisin over the matter shall do well to consider the aforesaid observations made by this Court and dispose of the bail application of the Petitioner on the same day. While considering the bail application of the Petitioner, the learned trial court shall also apply the principles of parity.
6. The case diary be made available on the date of surrender on an application being filed by the Petitioner prior to his date of surrender along with a copy of today’s order.
7. The ABLAPL is disposed of accordingly.
Urgent certified copy of this order be granted as per rules.
