Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 111/61(2)/3(5) of the Bharatiya Nayay Sanhita, 2023 and under Sections (25-1B)a/25(6)/26/35 of the Arms Act and under Section 17 of the C.L.A Act in connection with Karra PS Case No. 21 of 2025 corresponding to G.R No. 272 of 2025.

Learned counsel for the petitioner submits that the entire allegation of recovery of 9 mm cartridges loaded from the magazine of Carbine and 6 PLFI pamphlets is labelled against co-accused Pawan Kumar @ Pawan Mahto and the petitioner has been made accused in the present case merely on the basis of confessional statement of co-accused.
Learned counsel submits that the co-accused, namely, Karma Barla in B.A No. 6666 of 2025, Pawan Kumar @ Pawan Mahto in B.A No. 6806 of 2025, Deepak Munda B.A No. 11059 of 2025 and Karan Kumar Oraon in B.A No. 10754 of 2025 have been granted bail by the Co-ordinate Bench of this Court vide orders dated 12.08.2025, 08.08.2025, 07.01.2026 and 18.12.2025 respectively and the petitioner is in custody since 01.05.2025. As such, learned counsel for the petitioner submits that the petitioner may be enlarged on bail.

Learned APP also opposes the prayer for bail of the petitioner.

Having regard to the fact that petitioner is in custody since 01.05.2025 and the co-accused have been granted bail by a Co-ordinate Bench of this Court, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Khunti in connection with Karra PS Case No. 21 of 2025 corresponding to G.R No. 272 of 2025.

It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

Accordingly, the instant bail application stand allowed.
