THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 17072 of 2026 ORDER: The present writ petition is filed questioning the action of the respondents in not extending the annual grade increments and pay revision scales to the Petitioner as illegal and arbitrary. 2. The Petitioner was initially appointed as Assistant Commissioner, Endowments Department, in the year 2011 and thereafter, he was promoted to the post of Deputy Commissioner on
07.02.2024. It is stated that from 29.01.2021 to 26.10.2021, the Petitioner was under suspension on account of alleged misconduct, which was subsequently dropped on 16.11.2023. It is also stated that the Petitioner was kept under waiting period from 03.04.2022 to 30.06.2022 and from 01.07.2022 to 22.10.2022, for which the Petitioner is entitled for salary. It is further stated that thereafter the Petitioner was not paid salary. 3. It is stated that on account of compulsory waiting period working at various places and suspension period, there is anomaly in the fixation of pay of the Petitioner in the cadre of the Assistant Commissioner and Deputy Commissioner, which requires detailed examination. In the said scenario, the Petitioner had submitted a representation on 13.10.2024, however, there is no further steps taken thereon. 4. Learned Assistant Government Pleader for Services-II Submits that the representation of the Petitioner dated 13.10.2024 would be examined and appropriate orders will be passed. 3

In the light of the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, with the following directions: i) The Respondents shall consider the representation of the
Petitioner dated 13.10.2024 with regard to the rectification of the
pay of the Petitioner in the cadres of Assistant Commissioner
and Deputy Commissioner within a period of three (3) months
from the date of receipt of a copy of this Order and
communicate the same to the Petitioner; ii) There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. __________________ NYAPATHY VIJAY, J Date: 01.07.2026
