08 /24.03.2026: Heard the learned counsel representing the petitioner and the learned counsel representing the respondents.
2. This writ application is in respect of admission in the Medical College.
3.
Learned counsel for the petitioner submits that the petitioner should have been allotted a better ranking Medical College in Jharkhand inspite of there being sufficient number of seats available due to removal of the candidates who were given admission on the basis of forged, fabricated or false/incorrect caste certificate.
2026:JHHC:8248 2
4. Today, when the matter is listed, Mr. Anoop Kumar Mehta,
learned counsel for the respondent no. 3-Jharkhand Combined Entrance Competitive Examination Board submits that only one seat in the Medical College of Hazaribagh is available, that too, is reserved for Schedule Caste candidate and one unreserved seat in Palamau is available for admission.
5. So far as this petitioner is concerned it is admitted that the petitioner is studying in Palamau Medical College. Since the petitioner is Schedule Tribe candidate she cannot be placed in Hazaribagh Medical College in Schedule Caste category also.
6. At this stage, learned counsel for the petitioner submits that the petitioner has raised complaints against two of the students who got admission in RIMS and the respondents are yet to take a decision on the said.
7. It is not possible to say whether this petitioner can be accommodated if those two persons are removed. There may be several other persons higher in rank than the petitioner, who may have better claim. Further, no decision has been taken in respect of those two students, neither they are party to this writ petition.
8. Thus, no relief can be granted to this petitioner on the facts as narrated in the writ petition, as it stands today. The writ petition stands dismissed.
9. The petitioner is at liberty to approach the appropriate authority in future, if any cause of action arises.
