JUSTICE B M SHYAM PRASAD - 3 - HC-KAR CNR: KAHC010598522026 NC: 2026:KHC:49323 WP No. 27026 of 2026 ORAL ORDER The petitioners assert that they own properties along the State Highway No. 102 in Honnavalli Gram Panchayath, Honnavalli Hobli, Tiptur Taluk, Tumakuru District, and their grievance is with the Endorsements both dated 24.08.2026 [Annexures – G and G1] issued by the respondent. The respondent has issued this Endorsement informing the petitioners that NOC would be issued to avail electricity unless they obtain appropriate No Objection Certificate [NOC] from the concerned with the Public Works Department. Sri. Naveen J N, the learned counsel for the petitioners, relies upon the Orders of this Court dated 04.11.2024 in the writ petitions in W.P. No.21121/2024 connected matters and submits that this Court in these petitions filed by the neighbouring property owners has quashed similar Endorsements calling upon the respondent to reconsider the request for issuance of NOC in accordance with prescribed parameters and that the respondent has issued NOC. - 4 - HC-KAR CNR: KAHC010598522026 NC: 2026:KHC:49323 WP No. 27026 of 2026 This Court’s Order dated 04.11.2024 is perused in the light of the petitioners' assertion that they own property adjacent to the properties that are owned by the petitioners in such petitions. If the respondent has issued NOC to avail electricity after this Court's order, the petitioners must also be entitled to the same but subject to satisfying the respondent on the compliance with all the required parameters. Hence the following. ORDER [A] The petition is allowed-in-part. [B] The respondent's impugned Endorsements both dated 24.08.2026 [Annexures – G and G1] are quashed reserving liberty to the petitioners to file a copy of this Order with the respondent within two [2] weeks from the date of receipt thereof. [C] The respondent is called upon to examine whether the petitioners have complied with all parameters and are - 5 - HC-KAR CNR: KAHC010598522026 NC: 2026:KHC:49323 WP No. 27026 of 2026 entitled to NOC as in the case of the petitioners in the writ petitions in W.P.
