Mr. Soumalya Ganguli ......for the appellant Ms. Ruxmini Basu Roy Mr. Shameek Chakraborty ......for the respondent no. 1 The instant appeal is directed against an award dated 09.02.2026 passed by the Commissioner of the Employees’ Compensation, Durgapur in connection with Claim Case No. 57 of 2023. By the impugned order, the Commissioner, Employees’ Compensation, Durgapur has awarded a sum of Rs. 9,19,567/- along with simple interest @ 12% p.a. from the date of accident till the realization of compensation amount and a further sum of Rs. 5,000/- towards funeral expenses of the deceased. Pursuant to the impugned award, the appellant had deposited the entire compensation amount aggregating to Rs. 12,27,193/- with the Commissioner, Employees’ Compensation, Durgapur on 04.06.2026. A copy of the receipt of compensation has been filed with the records. 2 Pursuant to the orders of Court, the parties were directed to arrive at an amicable consensus to bring an end to this litigation. It is submitted on behalf of the parties that they have aggrieved to resolve their disputes and differences and the appellant shall pay a sum of Rs.11,00,000/- in full and final settlement to the respondent no. 1. The details of the bank account of the respondent no. 1 are provided below— Bank Name and Branch-: Central Bank of India, Durgapur, Account No.- 2242905294. In view of settlement by and between the parties, liberty is granted to the appellant to withdraw the entire amount deposited with the Commissioner, Employees’ Compensation, Durgapur and pay a sum of Rs. 11,00,000/- out of the said amount to the above account in favour of the respondent no. 1. The entire excess amount is to be retained by the appellant. The above exercise should be completed within two weeks from the date of this order. With the above directions, FMAT (WC) 11 of 2026 alongwith the connected applications, stand disposed of. Pursuant to the orders of Court, Mr. Mahamudul Islam, Legal Manager of the appellant is present in Court. The appellant is directed to 3 intimate the respondent no. 1 of this order and the fact of deposit of the said amount in favour of the respondent no. 1.
