Petitioner is before this Court seeking for the following relief: "THEREFORE, it is respectfully prayed that this Hon'ble Court may kindly be pleased to set aside the order passed by the learned II Addl. Civil Judge and J.M.F.C Tumakuru in Crime No.201/2020 dated 17.06.2021 and restore the case directing the respondent police to conduct re-investigation in Crime No.201/2020 for the offence p/u/s 279, 304(a) of Indian Penal Code and Section 134 (a and b) and 187 of Indian Motor Vehicles Act, in the interest of justice." 2. What has been challenged is the order accepting the 'C' report filed by the Investigating Officer. The order reads as follows: "Perused the records, C report is accepted for the present". 3. Apart from the above, there is no application of mind in respect to the said order. The 'C' report has been submitted. The acceptance of the 'C' report without notice to the complainant and without providing an opportunity for filing a protest memo is contrary to the applicable law. 4. In that view of the matter, this Court passes the following order: (i) The criminal petition is allowed. (ii) The order dated 17.06.2021, accepting the 'C' report, is set aside. (iii) The matter is remanded to the II Additional Civil Judge and JMFC, Tumakuru, for fresh consideration by permitting the petitioner to furnish such documents and records that may be available with the petitioner along with the protest memo to be filed in respect thereto.
