Learned advocate appearing for the petitioner submits that petitioner has been implicated in the instant case for alleged recovery of 25 bottles of codeine mixtures and is in custody for one year one month. Charge-sheet has been submitted and charges have been framed. Learned advocate for the State opposes the prayer for bail and submits that there are ten criminal cases pending against the present petitioner. Be that as it may, petitioner is already in custody for one year one month and in the present case prosecution has relied upon 18 witnesses in order to prove its case. Having considered the quantum of seizure in the present case and the fact that time will be consumed in concluding the trial, I am
2 inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. As such, petitioner namely, Ajit Mondal @ Vasan shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act, Barrackpore. If on bail, the petitioner shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of North 24 Parganas without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 474 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
