Even then the respondents Auhority without following the guidelines while the 1st petitioner have Applied for the post of village agriculture Assistant Grade II, at the date of applying for post the petitioner is clear eligible for the above post i.e within Age and the 2nd petitioner is also eligible but the respondents Authority is not giving weightage of marks for the service rendered by the petitioners while giving the same to the other similarly situated persons have got it is illegal, arbitrary, discriminatory and contrary to the notification No.01/2019 dated 26.07.2019 and consequently set-aside the same by direct the respondents to consider the appointment of the village Agriculture Assistant Grade II by the petitioners are entitled for the waitage Marks and pass such order or orders in this Honble Court may deem fit and proper in the circumstances of the case. GP for Village and Ward Secretariats The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.17204 of 2020 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a Writ of Mandamus declaring action of the respondents herein in issuing the impugned speaking order Lr.No.A5(1)489/2019-2 against the petitioners on 02.09.2020 as illegal, arbitrary and violative of Recruitment Rules and consequently direct the respondents to set aside the same and consider the appointment of the petitioners to the post of Village Agriculture Assistant Grade-II.” 2. Heard the learned counsel for the petitioners and the learned counsel for the respondents. 3. Learned counsel for the petitioners submits that the respondents issued notification No.1 of 2019, dated 26.07.2019 inviting the applications for recruitment to the post of Village Agriculture Assistant Grade-II. The respondents have announced results, wherein the 1st petitioner secured 65.25 marks and 2nd petitioner secured 50.25 marks and the selection committee have conducted the interviews, however, the respondents have not given appointment to the petitioners and passed the speaking order dated 02.09.2020 rejecting the appointment of the petitioners as the petitioners are not eligible for weightage marks and they are crossed the age as prescribed in the notification dated 26.07.2019. 4. Learned Assistant Government Pleader for Services-II would submit that the posts that are notified as per notification dated 26.07.2019 have been filled 4 with the selected candidates, hence, the present Writ Petition has rendered infructuous, hence prayed to dismiss the Writ Petition. 5. On the other hand, learned counsel for petitioners submits that there are some un-filled vacancies in Guntur and Kurnool Districts and requested to direct the respondents to consider the case of the petitioners in un-filled vacancies. 6. Considering the facts and circumstances of the case, without going into the merits of the case, this Court is inclined to dispose of the present Writ Petition directing the petitioners to file an application/representation before the concerned authority within a period of two weeks from the date of receipt of copy of this order asserting that to consider the case of the petitioners to be appointed as Village Agriculture Assistant Grade-II in the un-filled vacancies, if any. On filing of such applications, the respondent authorities are directed to examine the same, in accordance with law, within a period of four weeks from the date of receipt of applications and communicate the same to the petitioners. There shall be no order as to costs.
