17.09.2026 Item No.05 Court No.11 Avijit Mitra CPAN 869 of 2026
Tanishqa Debnath & ors. -Versus- Professor Dr. Mukul Bhattacharjee, Vice Chancellor, West Bengal University of Health Sciences & ors. in MAT 1028 of 2026
Mr. Pappu Adhikari …… for the petitioners/applicants Mr. Billwadal Bhattacharyya, Ld. AAG, Mr. Lokenath Chatterjee, Ms. Mary Datta, Mr. Rajdeep Mantha ….for the alleged contemnors Mr. Nilotpal Chatterjee ….for the Indian Nursing Council
The present contempt application has been preferred by the petitioners/applicants alleging violation of an order dated 25th June, 2026 passed in MAT 1028 of
2026. By the said order, this Court directed the respondents to grant provisional registration to the students/appellants in MAT 1028 of 2026 in the academic session 2025-2026 and to issue admit cards to enable them to participate in the B.Sc. Nursing first semester examination commencing on and from 30th June, 2026. Records further reveal that assailing the said order, the respondents therein preferred a Special Leave Petition which was dismissed upon contested hearing on 10th July, 2026. Mr. Adhikari, learned senior advocate appearing for the petitioners/applicants submits that the alleged
contemnors have deliberately violated the directions contained in the order of this Court dated 25th June,
2026. Mr. Bhattacharyya, learned senior advocate appearing for the alleged contemnors submits that the order of this Court has already been complied with and for the unintentional delay which had occurred, he tenders unconditional apology on behalf of the alleged contemnors. Mr. Adhikari submits that though examination has been held, the results have not yet been published. Responding to such submission, Mr. Bhattacharyya, submits, upon instruction, that the results pertaining to the concerned examination would be published, as expeditiously as possible, preferably, within a period of three weeks from date. As our order has ultimately been complied with and as an unqualified apology has been tendered on behalf of the alleged contemnors, we are not inclined to proceed with the contempt application any further. The contempt application being CPAN 869 of 2026 is, accordingly, disposed of. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Partha Sarathi Chatterjee, J.) (Tapabrata Chakraborty, J.) 2
