JUSTICE B.PRAMOD ORAL ORDER Petitioner has sought for the following main relief: "Issue a writ of Mandamus or any other writ, order or direction to Respondent No.1 and 4 to consider the Letter dated 16.09.2023 issued by Respondent No.2 vide - Annexure-F recommending to condone the delay in filing application for subsidy and consequently grant subsidy to the Petitioner Company." 2. The petitioner-Company claims that respondent No.3 sanctioned a term loan of Rs.1,20,00,000/- (Rupees One Crore and Twenty Lakh only) on 30.07.2019 under the Interest Subvention Scheme rolled out by respondent No.1 for the upliftment of Micro and Small-Scale Industries in the State. The said term loan was disbursed to the petitioner in a timely manner in terms of the Sanction Letter dated 30.07.2019 at Annexure-A. Under the Scheme, it was assured that the petitioner-Company would be entitled to interest subsidy upon complete repayment of the loan. The petitioner completed - 4 - HC-KAR CNR: KAHC010186572025 NC: 2026:KHC:51272 WP No. 9694 of 2025 construction of the plant and commenced production in the month of April 2021. 3. That being the case, the petitioner visited the office of respondent No.3 soon after commencement of production and sought issuance of the Investment Certificate to claim subsidy from respondent Nos.1 and 2. Despite the said request, respondent No.3 did not issue the Investment Certificate. On 18.05.2022, when the petitioner-Company visited the office of respondent No.3, apprised it of the gravity of the situation and sought issuance of the Investment Certificate to avail the subsidy, it was found from the records of respondent No.3 that the Investment Certificate had been prepared much earlier, i.e., on 18.08.2021, but had never been dispatched to the petitioner-Company. The petitioner-Company thereafter obtained the said Investment Certificate on 18.05.2022. - 5 - HC-KAR CNR: KAHC010186572025 NC: 2026:KHC:51272 WP No. 9694 of 2025 4. The petitioner-Company submitted an application along with the requisite documents to respondent No.2 seeking subsidy. The said application was rejected on the ground that there was a delay in filing the same. Thereafter, the petitioner submitted a letter to respondent No.2 seeking condonation of the delay in filing the application for subsidy, contending that the delay was caused by respondent No.3 in issuing the Investment Certificate. Respondent No.4, after conducting an inspection of the petitioner-Industry, recommended condonation of the delay in filing the application seeking subsidy, as respondent No.3 had issued the Investment Certificate after a lapse of one year from the period referred to supra. 5. Respondent No.4 addressed a letter dated 16.09.2023 to respondent No.2. However, the same has not been considered by respondent No.2 despite a considerable period having elapsed. - 6 - HC-KAR CNR: KAHC010186572025 NC: 2026:KHC:51272 WP No. 9694 of 2025 6. The relief sought in the present writ petition is vague and lacks clarity. Hence, a writ of mandamus cannot be issued. 7. At this juncture, learned counsel for the petitioner submits that the petitioner would submit the necessary application/representation to respondent No.2, enclosing a copy of the letter dated 16.09.2023 at Annexure-F, seeking grant of subsidy, within a period of two weeks from the date of receipt of a copy of this order. 8. If such an application/representation is submitted to respondent No.2, respondent No.2 shall take into consideration the communication dated 16.09.2023, take necessary action thereon and communicate the outcome of such consideration to the petitioner-Company within a period of three months from the date of receipt of the application/representation. - 7 - HC-KAR CNR: KAHC010186572025 NC: 2026:KHC:51272 WP No. 9694 of 2025 Accordingly, the writ petition is disposed of with the above directions.
