Learned advocate appearing for the petitioners submits that petitioners are in custody for 1 year 7 months; charge-sheet has already been submitted and two of the accused persons have been granted bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that two accused persons who have been granted bail in CRM(NDPS) 1116 of 2025 and CRM(NDPS) 863 of 2025 from them, there has been no recovery made and they were arrested on the basis of statement of co-accused. So far as the present petitioners are concerned, there has been recovery from both the petitioners. Having considered the quantum of recovery in the present case, which is of 2.915 kgs. of Brown sugar, 5.946
2 kgs. of Sodium Carbonate and Acetyl Chloride, I am not inclined to release the petitioners on bail as rigours of Section 37 of the NDS act are attracted. As such, the prayer for bail of the petitioners is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1941 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
