Sarma, learned Legal Aid Counsel, who by means of this application filed under Section 5 of the Limitation Act, 1963 has prayed for condonation of delay of 85 days in preferring the appeal. Also heard Ms. B. Bhuyan, learned Addl. PP, Assam. Ms. Sarma, the learned Legal Aid Counsel by drawing the attention of this Court to the averments made in paragraph 4 has submitted that the delay has occasioned because of reasons beyond the control of the applicant. Ms. Bhuyan, the learned Addl. PP has not raised serious objection to the aspect of condonation of delay. Considering the above and also the settled law that an application for condonation of delay is required to be considered in a pragmatic and justice oriented approach the delay which is 85 days is accordingly condoned.
