The petitioner alleges that the private respondent has raised construction without obtaining sanctioned plan from the concerned Panchayat encroaching upon a portion of the petitioner’s land. Learned counsel for the private respondent produces copy of the sanctioned plan which prima facie demonstrates that the construction has been raised in terms of the said plan. The issue of encroachment raised by the petitioner shall be dealt with by the appropriate civil forum. In view of the above, this Court is inclined to hold that the writ petition is devoid of merits and is therefore dismissed. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. 2 Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
