Learned advocate appearing for the petitioner submits that petitioner is in custody for about 167 days and has been implicated in connection with the present case on wild accusations. Learned advocate for the State has submitted case diary, drawn the attention of the Court to the statement of the victim. I find that the age of the victim is 8 years and charge sheet has already been submitted. As the deposition of the victim is yet to be conducted before the learned Trial Court, I am of the view on stringent conditions petitioner may be released on bail. 2 Accordingly, Petitioner, namely, Swapan Kumar Das shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court (under POCSO Act) Barrackpore, North 24 Parganas. If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas North without the prior permission of the learned Special Court. Additionally, petitioner shall not enter the jurisdiction of Belgharia Police Station without prior permission of the learned Special Court. In case, there is any violation of the condition, the learned Trial Court would be at liberty to cancel the bail without further reference to this Court. Accordingly, CRM (R) 166 of 2025 is allowed. Report submitted be kept with the record. The Investigating Officer of the case is present in Court pursuant to the directions passed. His further appearance before the Court is dispensed with. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
