16.09.2026 IN THE HIGH COURT AT CALCUTTA Item No.M/L.224 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 1247 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Baishnabnagar Police Station Case No. 233 of 2026 dated 06.03.2026 under Sections 21(c)/27A/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Dipankar Mandal ... Petitioner. Mr. Sanat Kumar Das, Mr. Sujan Chatterjee, Mr. Rohan Bavishi ... For the Petitioner. Dr. Pradip Banerjee, APP, Mr. Anurag Sardar ... For the State. Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 24 bottles of Phensedyl. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. Prima facie, the records of the case reflect that rigours of Section 37 of the NDPS Act are attracted. As such, the prayer for bail of the petitioner is rejected. The petitioner will renew his prayer for bail after the evidence of the independent witnesses is over. Learned Trial Court is directed to split up the trial of the case by exhausting the process of law. If there is no progress in the case, petitioner will approach this Court after 31.12.2026. 2 Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. Let this order be communicated to the learned Trial Court. The application for bail, being CRM (NDPS) 1247 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
