Mr. Rajat Mittal, learned counsel for the Applicant. 2. Mr. B.N. Maulekhi, learned DAG, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Narpendra Singh, who has been accused in Case Crime No.371 of 2025, under Sections 109, 352 and 61 (2) of the BNS, 2023, at Police Station Kotwali, District Dehradun. The Applicant is in judicial custody since
28.10.2025. 4. As per the FIR, the victim was attacked by the two persons, namely, Sohail and Sanu, one of whom fired gun shot on the victim. Learned counsel for the Applicant had submitted that the Applicant has falsely been implicated in the present matter as he was not present on the day and place of incident, and there is no role assigned to the present Applicant of the crime. 5. In this regard, on the last date as directed and noted by this Court vide order dated 16.02.2026, in paragraph 3 direction has been passed for learned counsel for the State regarding the presence on the date of the incident and role of the Applicant. It is noted in paragraph 3 of the order-sheet that learned counsel for the Applicant submits referring to the police report page no.35 at point no.8, wherein, it is stated that
the Applicant was not present at the time when the gun shot was fired. 6. Learned State Counsel asserts to the said submissions that the Applicant was not present at the place of incident. 7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 8. Accordingly, bail application is allowed.
It is directed that the Applicant - Narpendra Singh, who has been accused in Case Crime No.371 of 2025, under Sections 109, 352 and 61 (2) of the BNS, 2023, at Police Station Kotwali, District Dehradun, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him. ( Ash ish Nait h an i, J.)
