GP FOR SERVICES I The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.16497 of 2026 O R D E R: The Writ Petition is filed questioning the action of the Respondents in initiating the Departmental Enquiry vide G.O.Ms.No.241 Revenue ( Vig-I) Department, dated 30.10.2024 under Rule 20 of the Andhra Pradesh Civil Services (Classification, Control and Appeal) Rules, 1991, as illegal and arbitrary. 2. The solitary Article of Charge framed against the Petitioner is that the Petitioner, while working as Station House Officer, Taluk Police Station, Kadapa, during period from 02.07.2004 to 29.03.2006, did not take action on the complaint given by the then M.R.O, Kadapa, against the encroachers of K.C. Canal land in Sy.Nos. 508, 509, 510, 511, 513, 514, 515 in an extent of Ac.7.76 cents of Gudur Village, Kadapa Mandal, which is classified as Kalva Poramboke land. 3. Learned counsel for the Petitioner submits that as a similar charge was issued against Sri E. Mallikarjuna, the Division Bench of this Court in W.A.No.1216 of 2025, dated 08.12.2025, directed the Respondent Authorities to conclude the enquiry within a period two months, in default, the Government will initiate the enquiry against the enquiry authority. 4. Learned Assistant Government Pleader submits that the present Writ Petition be disposed of in terms of W.A.No.1216 of 2025, dated 08.12.2025. 5. Considering the fact that as regards the very same allegations another individual claim was directed to be disposed of within a period of two months, the present Writ Petition is disposed of in terms of the 3 directions given by the Division Bench in W.A.No.1216 of 2025, dated 08.12.2025 as follows: i) The respondent Authorities shall conclude the enquiry initiated against the petitioner within a period of two (02) months from today. ii) In the event the enquiry is not completed within the time stipulated above, the charges levelled against the petitioner/appellant shall stands quashed. iii) If enquiry is not completed within the time stipulated herein above, the Government shall initiate proceedings against the enquiry authority as per G.O.Ms.No.91, General Administration (SER.C) Department, dated 12.09.2022. iv) The learned Assistant Government Pleader appearing for the respondents shall inform this order to the respondents forthwith. v) There shall be no order as to costs. The Registry is directed to append a copy of the Order in W.A.No.1216 of 2025, dated 08.12.2025, to this Order.
