JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.1 to 3 in Crime No.271/2026 registered by Vidyaranyapura Police Station, Bengaluru City, for the offences punishable under Sections 318(4), 61 read with Section 3 (5) of BNS 2023, are before this Court in these petitions filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. - 4 - HC-KAR CNR: KAHC010573932026 NC: 2026:KHC:51131 CRL.P No. 12737 of 2026 C/W CRL.P No. 13464 of 2026 3. FIR in Crime No.271/2026 was registered by Vidyaranyapura Police Station, Bengaluru City for the aforesaid offences against the petitioners herein, based on the first information dated 13.07.2026 received from Smt Jyothi M.S., W/o. Tarun Kamineni. Apprehending arrest in the case, the petitioners had approached the jurisdictional Sessions Court seeking anticipatory bail. Since their petitions were rejected, they are before this Court in these two petitions. 4. Perusal of the material on record would go to show that accused No.1 is the husband of accused No.2 and brother of accused No.3. It appears that accused No.1 was constructing an apartment building and the first informant and her husband had approached accused No.1 for the purpose of purchasing a three-bedroom, hall and kitchen apartment from accused No.1. Thereafter, they had entered into an agreement for sale with accused No.1 and allegedly had paid a sum of Rs.60,00,000/- under the agreement. - 5 - HC-KAR CNR: KAHC010573932026 NC: 2026:KHC:51131 CRL.P No. 12737 of 2026 C/W CRL.P No. 13464 of 2026 5. It is further alleged that certain amount was also paid to accused No.2 for the purpose of interior decoration of the apartment which was the subject matter of the sale agreement. Accused No.1, who had entered into an agreement for sale with the first informant after receiving the valid sale consideration from them, subsequently has sold the very same property in favour of the wife of accused No.3 under a registered sale deed dated 29.09.2023. Allegation against accused Nos.1 and 3 is of conspiracy and cheating. 6. From the aforesaid, it is apparent that there is a prima facie case as against accused Nos.1 and 3, and therefore, their prayer for anticipatory bail needs to be rejected. Considering the nature of allegation against accused No.2, who is the wife of accused No.1, I am of the opinion that her prayer for grant of anticipatory bail can be answered affirmatively. Accordingly, the following: - 6 - HC-KAR CNR: KAHC010573932026 NC: 2026:KHC:51131 CRL.P No. 12737 of 2026 C/W CRL.P No. 13464 of 2026 O R D E R i) Criminal Petition No.13464/2026 is partly allowed. ii) Criminal Petition No.12737/2026 is dismissed iii) The criminal petitions are dismissed as against accused Nos.1 and 3 and allowed insofar accused No.2 is concerned. iv) The respondent - Police or any other police in the State of Karnataka are directed to release the accused No.2 in the event of her arrest in Crime No.271/2026 registered by Vidyaranyapura Police Station, Bengaluru City for the offences punishable under Sections 318(4), 61 read with Section 3 (5) of BNS 2023, subject to the following conditions: a) Accused No.2 shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a - 7 - HC-KAR CNR: KAHC010573932026 NC: 2026:KHC:51131 CRL.P No. 12737 of 2026 C/W CRL.P No. 13464 of 2026 sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. b) Accused No.2 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Accused No.2 shall not tamper with the prosecution witness and she shall co- operate with the police for investigation and appear before them whenever called upon. d) Accused No.2 shall not involve in similar offences in future.
