This Contempt Case has been filed complaining willful disobedience in implementing the final orders in W.P.No.12308 of 2021 dated 28.03.2023 passed by this Court and thus the Respondents committed offence under Sections 10 and 12 of the Contempt of Courts Act, 1971. Hence they are liable for punishment under the provisions of the Act, 1971, for which learned counsel for respondents filed counter affidavit on behalf of respondent Nos.2 to 5 and also filed a memo dated 13.11.2025 enclosing the speaking orders of the respondents wherein it is stated as under: “You are aware that the corporation preferred a writ appeal in WA No.525/2001 against the orders passed in WP No.19962/1997, dated 20.08.1997, and, on contest, the Hon’ble Court allowed the Writ Appeal by setting aside the orders passed in WP No.19962/1997 dated 28.04.2001 with an observation that “The order of learned single judge does not show that the first respondent (your name is mentioned as R1) fulfill the said conditions of G.O.Ms.No.212 and further there is no clear vacancy existing in the Corporation to give benefit as per the G.O.Ms.212 which does not arise in this case and as such the orders of the single judge is set aside and the appeal is allowed no costs. That, since the appeal of the corporation was already allowed as above and since there is no existing vacancy against which you are appointed, as also held by the Hon’ble Division Bench and since you have not completed the minimum required period as per G.O Ms.No.212, dated 22.04.1994, you have a shortfall of 6 days for the regularization of services as per the said G.O, and hence are not entitled to seek regularization. 4 Further you are found not entitled to take shelter under the judgment of Umadevi as you have not completed 10 years of service as on 10.04.2006 and only by virtue of the interim orders passed in WPMP No.24212 of 1997 you have continued in the said post which was later vacated by the Hon’ble Division Bench more so since your case for non-eligible for regularization attained finality under order of the Hon’ble Court in WA No.525/2001. Further, there is no clear vacancy in the corporation for the post held by you, and in any view of the matter, you are not entitled to seek regularization of your services. That in respectful compliance with the Orders of the Hon’ble High Court in WP No.12308 of 2021 and in the light of your representation submitted vide 1st reference, is examined in detail. That on careful consideration of the entire matter, for each of the above reasons, you are not entitled to regularization of your services, and moreover, you have already been superannuated and relieved on date 28.02.2025, and hence your representations are liable to be rejected, and accordingly, the same are hereby rejected.” 2. The above facts reiterated in other counter-affidavits also. As per the memo filed by the Respondents, whereunder they have filed proceedings of the 2nd Respondent dated 11.11.2025 under which the claim of the petitioner for regularization was rejected since the services of the petitioner were already superannuated on 28.02.2025. 3. In view of the orders passed by this Court in Review I.A.No.3 of 2024 in W.P.No.12308 of 2021 and after considering the facts as narrated in the counter-affidavits, this Court is of the considered opinion that the petitioner did not make out any case of contempt to punish the respondents under Sections 10 and 12 of the Act, 1971 since the orders impugned in Contempt proceedings was reviewed, hence the orders of this Court were 5 not in existence in toto but modified. Therefore, the order impugned in this petition cannot be enforced under the provisions of the Contempt of Courts Act, 1971. 4. Accordingly, the Contempt Case is closed.
