Case No. 438 of 2024 corresponding to N.D.P.S. Case No. 05 of 2025 for the offence registered under Sections 17(b), 21(b) and 27(a) of the N.D.P.S. Act pending in the Court of learned Principal District and Sessions Judge, Seraikella Kharsawan, is pressed into motion. Earlier bail application of this petitioner was rejected on merit on 30.07.2025 and present bail application is renewed on the ground that the charge has been framed on 10.06.2025 and out of eight witnesses, only one witness has been examined. The petitioner is in custody since 07.12.2024. Learned A.P.P. opposed the bail petition. It is submitted that the matter involves seizure of 20.37 gm. of brown sugar from the petitioner, which is intermediary quantity and trial has just commenced. This petitioner has criminal antecedent of similar nature of offence. Under the circumstances, I am not inclined to enlarge the petitioner on bail.
