Learned counsel appearing on behalf of the Panchayat submits that the Panchayat has no objection to the petitioner utilizing the said land, provided that the petitioner does not dump or dispose of any garbage in the adjacent canal. In view of the above, there is no necessity to keep the present writ petition pending. The petitioner shall, during the course of the day, submit an undertaking before the Pradhan of the Panchayat stating that he shall not throw or dump any garbage into the adjacent canal in connection with the marriage ceremony of his sister, which is scheduled to be held tomorrow. 2 Upon submission of such undertaking, the petitioner shall be permitted to utilize the relevant land. It is made clear that in the event of any violation of the undertaking, the Panchayat shall be at liberty to take appropriate steps against the petitioner in accordance with law. Accordingly, WPA 559 of 2026 stands disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
