Kausik (Allowed) CRM (NDPS) 220 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Burrabazar Police Station Case No. 271 of 2023 dated 10.10.2023 under sections 20(b)(ii)(c)/29 of the NDPS Act, 1985. And In the matter of : Sk. Azad ……Petitioner. Mr. Apalak Basu Mr. Nazir Ahmed Mr. Arnab Mukherjee Ms. Sarnali Gupta ……for the Petitioner. Mr. Avishek Sinha Mr. Debarshi Brahma ……for the State. Learned advocate appearing for the petitioner submits that the subject matter of the recovery in the present case relates to 21.464 Kgs. of Ganja. Petitioner is in custody for 2 years and 4 months. Learned advocate for the State opposes the prayer for bail and submits that the evidence of the 2 witnesses have been completed and prosecution would at the earliest conclude the evidence of the witnesses concerned. I have taken into account the subject matter of recovery in the present case, the period of detention of the present 2 petitioner and is of the view further incarceration is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed. Petitioner, namely, Sk. Azad shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Bench-1 Judge, City Sessions Court, Calcutta. If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Kolkata without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 220 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
