16.09.2026 Court No.35. M/L.259. Rakib (Rejected) CRM (NDPS) 1731 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 42 of 2026 dated 09.01.2026 under Sections 21(C)/27A/29 of the NDPS Act. And In the matter of : Atiur Kabiraj & Anr. ……Petitioners. Mr. Manjeet Saha ......for the Petitioners. Mr. Kallol Mondal, Ld. PP Mr. Pawan Kr. Gupta Mr. Sreyash Kr. Singh ……for the State. Learned advocate appearing for the petitioners submit that petitioners have been implicated on the basis of the statement of co- accused and the subject matter of the case in the present case relate to alleged recovery of 73 bottles of eskuf cough syrup. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account that there is an antecedent of the present petitioners which is under the NDPS Act being Kaliachak PS Case no. 58 of 2026. Having considered the same, I am of the opinion that petitioners need not be released on bail at this stage. Accordingly, CRM (NDPS) 1731 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
