Biswas Mr. M. Saha … for the Petitioner Mr. Bikash Kr. Singh …for the State 1. Learned advocate appearing for the petitioner submits that the petitioner was arrested on 15th March, 2026 and is in custody for six months. Alleged recovery in the present case is 763 grams of brown sugar from joint possession of the petitioner and three others. 2. Learned advocate for the State opposes the prayer for bail. Additionally it has been contended that the Chemical Examiner’s Report has not been submitted before the jurisdictional Court. 3. The concerned Chemical Examiner, be it of FSL or the CFSL, is directed to submit the Chemical Examiner’s Report within a period of three months, if not already submitted. 2 4. Having regard to the quantum of seizure in the present case, I am of the opinion that the rigours of Section 37 of the NDPS Act is attracted against the petitioner. 5. As such, the prayer for bail of the petitioner is rejected at this stage. 6. Accordingly, CRM (NDPS) 1677 of 2026 is dismissed. 7. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court. 8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
