JUSTICE G BASAVARAJA ORAL JUDGMENT The appellants have filed this appeal against the order dated 01.09.2026 passed in Crl.Misc.No.732/2026 by the learned II Additional District and Sessions Judge, Davanagere. 2. Despite service of notice, respondent No.2 remained absent and unrepresented. 3. Heard the arguments of the learned counsel for the appellant and also Sri K.Nageshwarappa, learned HCGP for respondent No.1. 4. On the basis of the complaint filed by Sharath, Basavapatna police have registered a case in Crime No. 117/2026 against accused No.1 to 42 and others accused 110 to 160 for the commission of offences punishable under Section 189(2), 191(2), 126(2), 127, 352, 115(2), 109, read with Section 190 of the Bharatiya Nyaya Sanhita, 2023 (for short - 4 - HC-KAR CNR: KAHC010634152026 NC: 2026:KHC:51450 CRL.A No. 1524 of 2026 'the BNS, 2023') and also read with Section 3(1)(r), 3(1)(s), 3(1)(s), 3(1)(za), 3(2)(v-a) of the SC and ST (Prevention of Atrocities) Act, 1989 (for short, 'the Act of 1989'). 5. It is submitted that accused Nos.5 and 41, who are appellant Nos.1 and 2, were arrested on 07.08.2026 and were remanded to judicial custody. The bail application was filed before the trial Court under Section 483 of the BNS, 2023 and the same came to be dismissed on 01.09.2026. Being aggrieved by this order, the appellants have preferred this appeal. 6. The accused are not required for further investigation. The offences alleged against the accused are not punishable with death or imprisonment for life. The accused have been in judicial custody since their arrest i.e., 07.08.2026. 8. Considering the nature and gravity of the offence and the previous antecedents of the accused, it is just and proper to allow this appeal. 9. Accordingly, I proceed to pass the following: ORDER (i) Appeal is allowed. (ii) The impugned order dated 01.09.2026 passed in Crl.Misc.No.732/2026 by the learned II Additional District and Sessions Judge, Davanagere is set aside. - 7 - HC-KAR CNR: KAHC010634152026 NC: 2026:KHC:51450 CRL.A No. 1524 of 2026 (iii) Consequently application filed under Section 482 of BNSS filed on behalf of the appellants who are accused Nos.5 and 41, is allowed. (iv) The appellants shall be released on bail in the event of their arrest in Crime No.117/2026 of Basavapatna Police on executing a self bond of Rs.50,000/- each with one surety to the satisfaction of Special Court. (v) Appellants shall not tamper or threaten the prosecution witness in any manner. (vi) Appellants shall assist the investigating officer in his investigation.
