Case No.225 of 2021 filed under Section 127 Cr.P.C. presently pending before learned Judicial Magistrate, 2nd Court, Katwa. Learned Counsel for the petitioner submits that because of the inordinate delay in proceeding with the said Misc. Case despite the passage of almost 5 years from the date of filing the petitioner’s valuable right to get speedy justice has been jeopardized. Therefore, the petitioner has prayed for appropriate direction upon the Trial Court for expeditious disposal of the said proceeding. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such service of copy of application upon the opposite party is dispensed with. Having considered submissions made on behalf of the petitioner and that the matter is pending for about 5 years, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. 2 In view of above, CRR 3514 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the said proceeding being Misc. Case No.225 of 2021 and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
