After arguing at some length, learned counsel for the petitioners prays to withdraw the present writ petition with liberty to file a recall application before the learned Debt Recovery Tribunal (hereinafter referred to as “DRT”) concerned, as the petitioners were not a party before the learned DRT.
4. Looking into the peculiar facts and circumstances of the case, we permit the petitioners the aforesaid liberty to move such an This is a digitally signed order. application before the learned DRT concerned within a period of one week from today.
5. Furthermore, petitioners are also permitted to bring on record all the documents with regard to the judgment of the criminal case which was initiated on the FIR filed by the Punjab National Bank/respondent whereby, it was held that the mortgaged documents were forged.
6. Petitioners are also permitted to file any other documents with regard to the aforesaid judgment, if they so desire.
7. In addition to the aforementioned, petitioners are also permitted to move an appropriate application seeking stay before the learned DRT concerned. The learned DRT shall consider and decide the stay application positively within a period of four weeks of filing of the same, after hearing all the parties concerned.
8. With the aforesaid observation, the petition along with pending application is disposed of.
