JUSTICE G BASAVARAJA ORAL JUDGMENT The appellants/accused Nos.1 to 3 have preferred this appeal against the order dated 04.08.2026 passed by the I Additional District and Sessions Judge, Chikkaballapura, in Crime No.111/2026. 2. On the basis of the complaint filed by Smt. Jyothi, Chintamani Town Police have registered a case in Crime No.111/2026 against accused Nos.1 to 3, who are the appellants herein, for the offences punishable under Sections 109(1), 115(2), 118(1), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short, ‘BNS’), and Sections 3(1)(r), 3(1)(s) and 3(2)(v-a) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short, ‘SC/ST (POA) Act’). 3. The appellants/accused Nos.1 to 3 were arrested on 04.07.2026 and were remanded to judicial custody. The appellants filed an application under Section - 4 - HC-KAR CNR: KAHC010558712026 NC: 2026:KHC:50112 CRL.A No. 1385 of 2026 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘BNSS’), seeking grant of regular bail, which came to be dismissed on 04.08.2026. 4. It is submitted by the learned counsel for the appellants that the injured has already been discharged from the hospital, the investigation has been completed and the charge-sheet has been filed against accused Nos.1 to 3 for the aforesaid offences. The wound certificate of the injured reveals that all the injuries are simple in nature. At the time of passing the order on the bail application, the charge-sheet was not filed. Now, the appellants/accused Nos.1 to 3 are not required for further investigation. 7. Considering the nature and gravity of the offence and prior antecedents of the appellants, I am of the opinion that, at this stage, without expressing any opinion on the merits of the case, it is just and proper to - 7 - HC-KAR CNR: KAHC010558712026 NC: 2026:KHC:50112 CRL.A No. 1385 of 2026 release the appellant/accused Nos.1 to 3 on bail with conditions. Accordingly, I proceed to pass the following; ORDER The Criminal Appeal is allowed. The order passed by the I Additional District and Sessions Judge, Chikkaballalpura, in Crime No.111/2026 dated 04.08.2026 is set aside. Consequently, the application filed under Section 483 of the BNSS, 2023, is allowed on the following conditions; (i) The appellant/accused Nos.1 to 3 shall be released on bail on executing a self-bond of Rs.50,000/- each with one surety for the likesum each, to the satisfaction of the Trial Court. (ii) The appellant/accused Nos.1 to 3 shall not tamper or threaten the prosecution witnesses in any manner.
