2. This writ petition is filed seeking the Court to quash the
order passed by the Karnataka State Administrative Tribunal at Bengaluru (for short, ‘the Tribunal’) dated 01.09.2026 in Application No.4142/2026.

Learned counsel for the petitioner submits that the petitioner was working as Superintendent, District Prison, Kolara and he was appointed as Jailor through order dated 11.02.2026. On 18.08.2026, the Superintendent of Command Centre visited the District Prison. Being satisfied with the conditions prevailing there, he entered his satisfaction in the visitation dairy. However, he passed an

order demoting the petitioner to the original post and transferred him to Central Prison, Shivamogga. Such decision of demotion was taken without issuing any notice to the petitioner and affording opportunity to him to project his version. Aggrieved by the same, the petitioner filed an Application before the Tribunal and has sought to stay the operation of the order by which he was demoted. However, the Tribunal failed to grant interim relief and therefore this writ petition is filed. Learned counsel thereby seeks to set aside the impugned order and consequently stay the operation of order No.E4/CR-44/2021-22 dated 24.08.2026 passed by respondent No.1.
4. On the ground that no prima facie case was found to grant interim relief, Tribunal declined to grant such a relief and ordered notice to the respondents therein. We do not find any serious lapse on part of the Tribunal in declining to grant the interim relief that is sought for by the petitioner.

5. Having gone through the entire material that is brought on record including the conditions laid down in
order dated 11.02.2026 and as we are of the view that it will not be fair on our part to make observations or give findings on the merits of the matter touching the main issue itself, as it may affect the decision taking power of the Tribunal in deciding the matter on merits and further as we concur with the decision of the Tribunal, that no prima-facie case exist to grant interim relief claimed, we are of the view that the writ petition deserves to be dismissed.
6. Accordingly, writ petition stands dismissed.
