D/L. 23 16.09.2026 Ct No. 2 Mujahid
CO 4454 of 2024
Smt. Shahana Roy Vs. Sri Kanad Mitra
Mr. Rohit Das Mr. Indradip Das Ms. Anugraha Sundas …for the petitioner
1. Present petition has been filed challenging the
order dated 8th November, 2024 whereby the request of the petitioner for seeking an adjournment for further cross-examination of the petitioner was declined by the learned trial court vide a detailed
order dated 8th November, 2024.
2.
Learned counsel for the petitioner today before this Court initiated the arguments with a statement that other party has played fraud upon the Court and only one adjournment sought by the
learned counsel for the petitioner was wrongfully rejected by the learned trial court.
3. However, perusal of the record tells and entirely different story and falsifies the averment made by the learned counsel for the petitioner. Perusal of the record indicates that the petitioner had sought more than ten adjournments on one reason or the other. This is other than the adjournments which
2
were granted on account of Bar resolution or the learned P.O. being on leave. The right to cross- examination cannot be an unlimited right. Moreover, the party cannot be allowed to make a false statement before this Court. Learned trial court has passed a detailed order giving all the details, there is no reason to interfere with the order of this case.
4. Hence the same is dismissed.
5. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
