By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in connection with FIR No. 1017/2021 dated 11.08.2021, registered at Police Station Sultanpuri, Outer District, Delhi, for offences punishable under Sections 302/34 of the Indian Penal Code, 1860. 2. The applicant had last approached the learned Sessions Court seeking regular bail in the year 2025. However, the said application came This is a digitally signed order. Many public witnesses are yet to be examined. Release of the applicant / accused before examination of material witnesses can provide him an opportunity to approach and influence the witnesses. Therefore, no ground is made out to release the applicant / accused on bail at this stage. The application is accordingly dismissed. The observations made hereinabove shall have no bearing on the merits of the case at any stage of proceedings. Application stands disposed off accordingly.” 3. Mr. Sumer Singh Boparai, learned counsel for the applicant, submits that subsequent to the said order passed by the learned Sessions Court, all material public witnesses stand examined. It is further contended that co-accused Sahil @ Gullu has been granted regular bail vide order dated 15.04.2026 passed by the learned Sessions Court, and that the applicant ought to be enlarged on bail on the same considerations. 4. It is borne out from the record that the applicant last approached the learned Sessions Court more than one year ago. It is further the applicant’s case that, subsequent thereto, the trial has progressed substantially, and all material public witnesses now stand examined. The applicant also places reliance on the aforesaid order of the learned Sessions Court whereby bail has been granted to a co-accused Sahil @ Gullu and seeks parity therewith. 5. In view of the aforesaid developments since the passing of the last order by the learned Sessions Court on 29.04.2025, I am of the view that it would be appropriate for the applicant to approach the learned Sessions Court afresh in the first instance.
