This petition is filed to quash proceedings in S.C. No. 572/2025 arising out of Crime No.473/2017 registered by Kumaraswamy layout Police Station, pending on the file of Sessions Judge (CCH-64), Bangalore. 3. It is submitted that the charge sheet is filed against the absconding petitioner and the trial against the remaining accused is held in a separate proceeding and the accused in the said case have been acquitted. It is further submitted that the allegations against the petitioner are the same as that of the remaining accused who have been acquitted. Thus, it is contented that the trial is a futile exercise. 5. The Court is of the view that since the petitioner was not amenable to the process of the Court for so many years, petitioner cannot seek to quash the proceedings. The petitioner has to face the trial. The case has to be decided on the basis of the evidence to be led against the petitioner. 6. Accordingly, the Criminal Petition is dismissed.
