1. In terms of order dated 2nd September, 2026 matter is heard today when Mr. Bhattacharyya, learned Additional Advocate General appears on behalf of State respondents and files a communication dated 16th September, 2026 of Inspector-in-Charge, Md. Bazar Police Station enclosing seizure list and same is taken on record. Copy of said communication dated 16th September, 2026 along with seizure list is made over to learned advocate representing petitioner.
2. It is disclosed in communication dated 16thSeptember, 2026 that in connection with Md. Bazar Police Station Case No.267/26 dated 30th July, 2026 one Amir Sohel Mondal was arrested on 10th August, 2026 from a lodge at Sonajhuri, Police Station- Sanitinekatan. After interrogating said Amir Sohel Mondal alleged search and seizure operation was conducted at the residence
of Amir Sohel Mondal at Bhedia, Police Station- Ausgram on 10th August, 2026 between 13.05 hrs. and 18.05 hrs. It is disclosed that while whole process of search and seizure was continuously audio videographed in presence of two independent witnesses and a lady police personnel.
3. Since said search and seizure operation was conducted on 10th August, 2026 by concerned police authorities in connection with criminal prosecution i.e. Md. Bazar Police Station Case No.267/26 dated 30th July, 2026, at this stage Court is not making any observation relating to said search and seizure operation. However, videography which was made recording said search and seizure operation held on 10th August, 2026 shall be preserved for consideration by appropriate authority/forum in future.
4. Mr. Roy, learned senior advocate representing petitioner has raised concern relating to manner of search and seizure operation which was conducted on 10th August, 2026 as well as according to petitioner search and seizure operation was also conducted on 9th August, 2026.
5. Submission made on behalf of petitioner that apart from 10th August, 2026 search and seizure operation was conducted on 9th August, 2026 is denied on behalf of State respondents.
6. Be that as it may, concerned police authorities are
directed to take steps while investigating Md. Bazar 2
Police Station Case No.267/26 dated 30th July, 2026 and conduct search and seizure operation strictly by following norms, if necessary.
7. With aforesaid observations, writ petition stands
disposed of.
