JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.4 in Crime No.210/2026 registered by Bommanahalli Police Station, Bengaluru City for the offences punishable under Sections 316(5), 318(4) and 351(2) read with Section 3(5) of BNS 2023, is before this Court in this petition filed under Section 482 of BNSS 2023 seeking anticipatory bail. - 3 - HC-KAR CNR: KAHC010557812026 NC: 2026:KHC:51133 CRL.P No. 12248 of 2026 2. Heard the learned counsel for the parties. 3. FIR in Crime No. 210/2026 was registered by Bommanahalli Police Station, Bengaluru City for the aforesaid offences against Manoj Nair and others, based on the first information dated 09.07.2026 received from Ayesha Kousar who is the alleged victim in the present case. Apprehending arrest in the case, the petitioner had filed Crl.Misc.No.7105/2026 before the jurisdictional Sessions Court, which was rejected on 25.07.2026. Therefore, she is before this Court. 4. Perusal of the material on record would go to show that accused No.1 is the husband of the petitioner herein. It appears that he was working as a Relationship Manager with HDFC Bank, Koramangala Branch, Bengaluru. In the said capacity, he had visited the house of the first informant on 08.03.2024 for the purpose of assisting her to open a bank account. It is alleged that he had fraudulently linked his mobile phone to the bank - 4 - HC-KAR CNR: KAHC010557812026 NC: 2026:KHC:51133 CRL.P No. 12248 of 2026 account of the first informant and thereafter misappropriated funds from her bank account. The allegation against the petitioner is that certain amount was transferred from the bank account of the first informant to the account of the petitioner. 5. Learned counsel has brought to the notice of this Court that accused No.1, who is the husband of the petitioner, was arrested in the present case and granted regular bail by the jurisdictional Court of Magistrate. It appears that the amount which was transferred to the bank account of the petitioner was subsequently transferred to the bank account of her husband immediately thereafter. The petitioner, who is a married lady, has undertaken to co-operate with the Police for the purpose of investigation. Considering the nature of the allegations found against her in the first information, the following: - 5 - HC-KAR CNR: KAHC010557812026 NC: 2026:KHC:51133 CRL.P No. 12248 of 2026 O R D E R i) The criminal petition is allowed. ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.210/2026 registered by Bommanahalli Police Station, Bengaluru City for the offences punishable under Sections 316(5), 318(4) and 351(2) read with Section 3(5) of BNS 2023, subject to the following conditions: a) The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. b) The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 6 - HC-KAR CNR: KAHC010557812026 NC: 2026:KHC:51133 CRL.P No. 12248 of 2026 c) The petitioner shall not tamper with the prosecution witness and she shall co- operate with the police for investigation and appear before them whenever called upon. d) The petitioner shall not involve in similar offences in future.
