The Panchayat is not represented despite service. The petitioner claims to be a co-sharer in respect of the plot in question and alleges that the private respondent is raising construction therein without obtaining sanction from the concerned Panchayat. The petitioner submitted a representation in this regard before the concerned authority on 21st June, 2025 and seeks consideration of the same. Learned counsel for the private respondent produces copy of the sanctioned plan and receipt showing deposit of fees before the Panchayat for the purpose which demonstrates that sanctioned plan has been granted in favour of the private respondent by the Panchayat. Therefore it cannot be said that the construction raised by the private respondent is without sanction from the Panchayat. 2 The writ petition, being devoid of merit, is dismissed. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
