State of Uttarakhand Hon ’ble Ash ish Nait h an i, J. Mr. D.N. Sharma, learned counsel for the Applicant. 2. Mr. Chitrarth Kandpal, learned Brief Holder for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Kernail Singh @ Pintu Rodi S/o Preetam Singh, who has been accused in FIR No.130 of 2025, under Sections 109, 115 (2), 126 (2) and 351 (2) of the Bharatiya Nyaya Sanhita, registered at Police Station Gadarpur, District Udham Singh Nagar. The Applicant is in jail since 02.01.2026. 4. Learned counsel for the Applicant submits that the entire prosecution story is false, concocted and fabricated and the Applicant has falsely been roped in the present matter, and he is in jail since 02.01.2026. He further submits that there is an unexplained and inordinate delay in lodging the FIR. 5. Learned State Counsel has vehemently opposed the bail application of the Applicant. 6. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail. 7. Accordingly, bail application is allowed. It is directed that the Applicant - Kernail Singh @ Pintu Rodi S/o Preetam Singh, who has been accused in FIR No.130 of 2025, under Sections 109, 115 (2), 126 (2) and 351 (2) of the Bharatiya Nyaya Sanhita, registered at Police Station Gadarpur, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court.
