The petitioner is an accused in connection with Kunda P.S. Case No. 24 of 2025 corresponding to POCSO Case No. 97 of 2025. It has been alleged that on the pretext of marriage, the petitioner had enticed away the informant and had established physical relationship with her. It has also been alleged that the petitioner had taken the informant to Pune and kept her for two months and subsequent thereto the petitioner had dropped her at Lawalong, Chatra and fled away. Learned counsel for the petitioner has submitted that the essence of the allegations would reveal that there is a love affair between the petitioner and the informant. It has further been submitted that the petitioner is in custody since 28.08.2025. Learned counsel further adds that the medical report is not supportive of the allegation of physical relationship. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner and has submitted that the medical report indicates that the informant was carrying a pregnancy of 5 weeks. Regard being had to the nature of offence and the medical report which indicates that the informant is pregnant, I am not inclined to admit the petitioner on bail and the same is accordingly rejected.
