Sri Saravana S., the learned counsel for the petitioners, and Sri. Sri Saravana S submits that this Court must invoke its jurisdiction under Article 226 of the Constitution of India because the petitioners can demonstrate with the recent notification that the petitioners will be entitled to demonstrate that they can apply for a modification with reduced set back requirements. This Court must observe - 4 - HC-KAR CNR: KAHC010626022026 NC: 2026:KHC:49621 WP No. 28568 of 2026 that this and every other aspect could be considered by the appellate authority, which is a fact-finding authority as well. Therefore, with all just liberties, the petition is disposed of relegating the petitioners to alternative remedy. Sd/- (B M SHYAM PRASAD) JUDGE JY List No.: 2 Sl No.: 4
