Sl.16 16.09.2026 Court No.6 BP C.O. 3169 of 2026 Sasanka Sekhar Dutta -versus- Achinta Roy & Anr. Mr. Nandadulal Bandyopadhyay ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 3rd Court at Paschim Medinipur to dispose of Other Suit No. 11 of 2021 expeditiously. The learned advocate appearing for the petitioner draws the attention of the Court to an order dated 29th August, 2025 by virtue of which a lease agreement dated 1st June, 2019 was impounded and sent to the Collector of Paschim Medinipur for ascertaining the actual stamp duties required to be made for impounding the same. He submits that thereafter repeated dated have been fixed awaiting report and the suit is pending for such reason. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. 2 From the ordersheets appended to this application this Court finds that by an order dated 29th August, 2025 the learned trial judge fixed 28th November, 2025 for filing of the report of the Collector from Paschim Medinipur. It further appears from the ordersheet that repeated dates were fixed awaiting report from the Collector, Paschim Medinipur. In the light of the submissions made by the learned advocate for the petitioners, C.O. 3169 of 2026 stands disposed of by requesting the learned Civil Judge (Senior Division), 3rd Court at Paschim Medinipur to take effective steps and ensure that the report of the Collector, Paschim Medinipur reaches the learned trial judge within a reasonable time. The learned trial judge is requested to make an endeavour to dispose of Other Suit No. 11 of 2021 as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
